Do foreign companies need a China trademark agency?

CNIPA states that a foreign company with no business domicile in China must entrust a legally established trademark agency to handle domestic trademark filing matters. We coordinate the business brief, documents and handoff to the appropriate professional route.

China uses a first-to-file principle for trademark registration. Early review matters before suppliers, distributors, trade fairs, marketplaces or public marketing expose the brand. For Madrid filings, WIPO also notes that a designation for China does not include Hong Kong or Macao.
